Article III Project Urges the Attorney General and House Democrats to Take Immediate Action On Supreme Court Security

WASHINGTON — Mike Davis, founder and president of the Article III Project (A3P), issued the following statement regarding the inaction by Attorney General Merrick Garland, House Speaker Nancy Pelosi, and House Democrats on urgent actions necessary to protect Supreme Court justices and their families from intimidation and violence.

“Following the leak more than two weeks ago of the Supreme Court’s draft majority opinion overturning Roe v. Wade, we have watched in horror as mobs of radical activists brazenly violate federal law by threatening Supreme Court justices and their families in their homes over a pending case. Minimally, this is plainly obstruction of justice, yet the FBI has made no arrests. These illegal acts have forced justices and their families to relocate from their homes. 

“As the 2020 murder of U.S. District Judge Esther Salas’ 20-year-old son Daniel and the serious wounding of her husband Mark made clear, doxxing the home addresses of federal judges is a deadly game. It is also a deadly game for politicians – like Senator Chuck Schumer and former White House Press Secretary Jen Psaki – to endorse these dangerous and illegal intimidation tactics of justices and their families at their homes. Attorney General Merrick Garland, a former federal judge, should be ashamed of his lack of leadership and his dereliction of duty in deterring these deadly threats. His general statement late yesterday—more than two weeks too late—is wholly inadequate. He must order arrests.

“The Supreme Court Police Parity Act, cosponsored by U.S. Senators Chris Coons (D-DE) and John Cornyn (R-TX), would provide Supreme Court police protection to the immediate families of the nine justices and other officers of the court. It already passed the Senate with unanimous support on May 9. Yet House Speaker Nancy Pelosi, who enjoys the 24/7 protection of a massive security detail, has politicized and delayed the urgent bill’s passage.

“Nancy Pelosi and her caucus know each day that passes without this bill being signed into law, the odds of a tragedy increase. Their obstruction leaves one to wonder if that’s what they want. The abortion industry is their key constituency,” said Davis.

The Article III Project (A3P) was founded by veteran GOP operative and attorney Mike Davis, who, after helping win the Senate confirmation battles of Neil Gorsuch and Brett Kavanaugh, developed the reputation as a “take-no-prisoners conservative eager to challenge the left with hardball tactics,” as reported in The New York Times. A3P defends constitutionalist judges, punches back on radical assaults on judicial independence (like court-packing) and opposes judicial and other nominees who are outside of the mainstream.

Davis previously served as Chief Counsel for Nominations to Chairman Chuck Grassley (R-Iowa) on the United States Senate Committee on the Judiciary and led the Senate confirmation of Justice Brett Kavanaugh and a record number of circuit court judges.
