A3P Statement on the Dobbs v. Jackson Decision Overturning Roe v. Wade

WASHINGTON – Mike Davis, Founder and President of the Article III Project, issued the following statement on the opinion from the Supreme Court in Dobbs v. Jackson that overturned Roe v. Wade.

“Oral arguments made it obvious that the Court would arrive at this decision. The unprecedented leak of a draft opinion sought to obstruct the Court’s decision-making process, but those attempts clearly failed. The Supreme Court proved that it is an institution that cannot be bullied into submission, no matter how extreme and dangerous the radical left’s tactics become.

“If Democrats and their liberal activist base don’t like Dobbs, they should win more elections for state legislative seats and change state laws through the democratic process–as our Constitution clearly envisions. Dobbs is now the law of the land, and the left must respect the high court’s decision. As recent threats to Supreme Court justices’ lives have revealed, Democrat leaders must watch their words and not do anything to encourage violence as they have done in the past.

“This decision gives the power to determine abortion regulations back to elected representatives in state legislatures, finally undoing nearly 50 years of lawlessness caused by liberal judicial activists legislating from the bench starting with Roe v. Wade. Roe federalized abortion regulations in a broad overreach by the Court. It’s crucial that Americans have a voice in shaping these polarizing laws that drive such strong discussion.

“If you don’t like COVID regulations, elect state representatives who will change them–or move to Florida. If you don’t like abortion regulations, elect state representatives who will change them–or move to California. That’s what democracy and our federalist system of government is all about. We congratulate the pro-life activists and elected officials who have fought for 50 years for this day and who have prevailed against the evil, anti-constitutional, and un-American decision that was Roe. Today, Roe joins Dred Scott, Korematsu, and Plessy in the ash heap of history of overturned Supreme Court precedents,” said Davis.

The Article III Project (A3P) was founded by veteran GOP operative and attorney Mike Davis, who, after helping win the Senate confirmation battles of Neil Gorsuch and Brett Kavanaugh, developed the reputation as a “take-no-prisoners conservative eager to challenge the left with hardball tactics,” as reported in The New York Times. A3P defends constitutionalist judges, punches back on radical assaults on judicial independence (like court-packing) and opposes judicial and other nominees who are outside of the mainstream.

Davis previously served as Chief Counsel for Nominations to Chairman Chuck Grassley (R-Iowa) on the United States Senate Committee on the Judiciary and led the Senate confirmation of Justice Brett Kavanaugh and a record number of circuit court judges.
