A3P Statement on President Biden’s Attack on the Supreme Court

WASHINGTON– Mike Davis, Founder and President of The Article III Project, issued the following statement on President Biden’s attack on the Supreme Court for declining to overturn the new abortion law in Texas on an emergency basis:

“President Biden’s ‘whole-of-government effort‘ to undermine the Supreme Court’s decision related to the Texas abortion law is an assault on the Constitution and the rule of law itself. The Supreme Court was quite clear that it was not weighing in on an emergency basis on the constitutionality of the Texas law, but would allow ongoing challenges to properly make their way through the judiciary. That is how our legal system works. The president’s disregard for the judicial process when he doesn’t immediately get his way speaks to his insincerity when he took the oath of office to preserve, protect, and defend the Constitution. 

“This is just the latest example of President Biden’s refusal to fulfill his duty to faithfully execute the law and his dangerous politicization of the high court. Just last month, President Biden undermined the rule of law and flagrantly disregarded a clear Supreme Court ruling by extending an unlawful CDC eviction moratorium. His sham Supreme Court commission, which aims to dismantle the judicial independence of the high court by packing it with left-wing political allies, clearly set the tone for this president’s administration. These continued attacks on our most sacred values and a repeated willingness to break the law should set the stage for congressional impeachment proceedings.”

The Article III Project(A3P) was founded by veteran GOP operative and attorney Mike Davis, who, after helping win the Senate confirmation battles of Neil Gorsuch and Brett Kavanaugh, developed the reputation as a “take-no-prisoners conservative eager to challenge the left with hardball tactics,” as reported inThe New York Times. A3P defends constitutionalist judges, punches back on radical assaults on judicial independence (like court-packing) and opposes judicial and other nominees who are outside of the mainstream.

Davis previously served as Chief Counsel for Nominations to Chairman Chuck Grassley (R-Iowa) on the United States Senate Committee on the Judiciary and led the Senate confirmation of Justice Brett Kavanaugh and a record number of circuit court judges.
